Middlesex OPP officer charged in 2019 crash that severely injured mother, daughter

Nearly nine months after launching an investigation into a serious crash involving an OPP cruiser and a taxi in London, Ont., the province’s police watchdog has laid charges against an officer.

The Special Investigations Unit (SIU) says Const. Timothy Groves is facing one count of dangerous operation of a motor vehicle and two counts of dangerous operation of a motor vehicle causing bodily harm. Groves has a court date in London scheduled for June 2.

An OPP cruiser collided with a taxi at the intersection of Southdale Road East and Verulam Street around 5 p.m. on July 28, 2019. OPP say the police vehicle was involved in the pursuit of suspects wanted in connection with an alleged robbery in Sarnia, Ont. Two suspects — a Etobicoke man and Mississauga man in their early 20s — were later arrested in connection with the robbery.

The Special Investigations Unit (SIU) said the woman and child were passengers in the taxi involved in the collision with the cruiser.

Porsche Clark, who was 27 at the time, and her then 9-year-old daughter, Skyla, were severely injured. In a Facebook post dated Aug. 5, Clark’s stepmother Tracey Griffen described their difficult recoveries and wrote that she was initially told at the hospital that “no one has ever survived an accident as bad.”

The police watchdog also previously confirmed that there was a separate crash involving an OPP cruiser before the crash involving the taxi, but said that incident did not fall under its mandate as there were no serious injuries.

The SIU says “the matter is now properly before the courts” and will not be making further comments. The SIU is an independent agency that investigates incidents involving police that have resulted in death, serious injury or alleged sexual assault.

LONDON, Ont. — A provincial police constable has been charged after his cruiser allegedly collided with a taxi in London, Ont., last summer and injured two people.

Ontario's police watchdog says it has charged Const. Timothey Groves with one count of dangerous operation of a motor vehicle and two of dangerous operation of a motor vehicle causing bodily harm.

The Special Investigations Unit says the incident took place while the officer was pursuing another vehicle on July 28, 2019.

It says the cruiser collided with the cab at an intersection.

The agency says two passengers in the taxi — a 27-year-old woman and her nine-year-old daughter — were seriously injured in the crash.

The officer is due in court on June 2.

OPP officer charged after London pair hurt in crash as police pursued Sarnia bank heist suspects

An OPP officer faces dangerous driving charges after a cruiser chasing suspects in a Sarnia bank heist collided with a cab in London last summer, badly injuring a mother and daughter, Ontario’s police watchdog says.

Middlesex OPP Const. Timothy Groves is charged with two counts of dangerous driving causing bodily harm and one count of dangerous driving, the Special Investigations Unit (SIU) announced Thursday.

Const. Groves, who is set to appear in a London court June 2, is on paid leave from the OPP, spokesperson Derek Rogers said, declining to elaborate

Provincial police had pursued a vehicle carrying two suspects into London July 28, 2019, when an OPP cruiser collided with a U-Need-A-Cab taxi leaving the No Frills grocery store at 635 Southdale Rd. about 5 p.m., the SIU said. Taxi passengers Porsche Clark, 27, and her daughter, Skyla, 9, were severely injured.

Clark was placed in a medically induced coma, undergoing surgery to repair her aorta and spleen, while Skyla had a spinal fusion, a procedure to permanently connect two or more vertebrae.

Both have been released from hospital and are living together, with support from a large team of excellent care providers, said Kevin Egan, who represents the pair with McKenzie Lake colleague Louis DelSignore.

“Both . . . are receiving excellent care, but continue to face significant obstacles to recovery. Each will likely require therapies and other care supports for the rest of their lives,” Egan said by email.

“The collision was horrific. The fact that they survived the crash is nothing short of miraculous,” Egan said. “We look forward to learning more about the police investigation and will watch the criminal proceedings with interest.”

Shortly before the Southdale crash, a police SUV collided with a car carrying three children, none of whom were injured. The car driver said he was turning left into Archie’s restaurant from Wellington Road, south of Southdale, when the crash occurred about 4:45 p.m.

The female officer driving the SUV stopped at the scene briefly before getting into the driver’s seat of an unmarked car driven by a plainclothed officer, who had also pulled over, and rejoining the pursuit, the father has said.

The SIU didn’t investigate that crash because nobody was seriously hurt. The watchdog investigates all deaths, serious injury and allegations of sexual assault involving police.

The chain of events began in Sarnia just before 4 p.m. when two masked men, wielding what appeared to be handguns, entered a TD Bank branch and ordfered everyone to the floor. One suspect jumped the counter to retrieve cash before the pair fled in a vehicle, police said.

OPP joined the pursuit when the vehicle reached Highway 402, and London police were alerted when the vehicle entered the city about 4:30 p.m., the SIU said.

The suspect’s car nearly collided with the taxi, which was northbound on Verulam Street on a green light, before the police vehicle entered the intersection and struck it, a U-Need-A-Cab official said at the time.

The string of crashes prompted the head of the London Taxi Association to question why provincial police were pursuing a fleeing vehicle through the city.

Under Ontario law, police may pursue a fleeing vehicle if a crime has been or is about to be committed. Police must determine whether the need to protect public safety by stopping the vehicle outweighs any possible public safety risks from the pursuit.

Hassan Ali, 21, pleaded guilty to bank robbery and wearing a disguise and was sentenced to four-and-a-half years in prison.

Also charged in the case is Mushin Aden, 23, who was scheduled to appear for an Ontario Court preliminary hearing May 12.
