CHATHAM, Ont. - Ontario’s police watchdog has charged an officer with manslaughter and negligence following the shooting death of a man last summer.

The Special Investigations Unit says officers with the Chatham-Kent detachment of the provincial police force were following a vehicle believed to have been involved in gasoline theft on July 7.

The arm’s-length agency says the vehicle ended up in the ditch dividing the lanes of Highway 401.

When one of the officers approached the vehicle, the SIU says, “his firearm discharged” and shot the driver.

The 24-year-old man died in hospital.

Const. Sean O’Rourke was charged with one count of manslaughter and one of criminal negligence causing death, and is due in court next month.

The union that represents OPP officers says it supports O’Rourke, along with the other officers “who acted in the good faith performance of their duties on the night of July 7, 2021.”

The Ontario Provincial Police Association says its lawyers will “vigorously” defend O’Rourke in court.

Police watchdog charges OPP officer in deadly shooting of man in Chatham-Kent

The Special Investigations Unit (SIU) has charged Constable Sean O’Rourke of the OPP with one count of manslaughter and one count of criminal negligence causing death.

The police watchdog has charged an OPP officer in the shooting death of a young man in Chatham Kent last July.

Joseph Martino, director of the Special Investigations Unit (SIU), said he has reasonable grounds to believe that an OPP officer committed a criminal offence in relation to the death of the 24-year-old man.

OPP officers of Chatham-Kent responded to a call about gasoline theft at a gas station between London and Chatham and proceeded to follow the vehicle believed to be involved, travelling westbound towards Highway 401.

“The vehicle ended up in the ditch dividing the highway. One of the officers approached the vehicle, and his firearm discharged and shot the driver,” said the SIU in its statement.

The man later died in hospital, the statement continues.

Constable Sean O’Rourke has been charged with one count of manslaughter and one count of criminal negligence causing death.

The police union, the Ontario Provincial Police Association (OPPA), said it “supports Provincial Constable Sean O’Rourke of the Chatham-Kent OPP Detachment, and all of our members who acted in the good faith performance of their duties on the night of July 7, 2021, while responding to a call for service on Highway 401 near Ridgetown, Ontario.

“It was an absolutely tragic event. Our lawyers will vigorously defend the actions of our officer in a court of law. The upcoming judicial process will be long and stressful for all impacted and we urge all OPPA Members who are impacted by this incident to reach out for professional and or peer mental health supports.”

A Chatham-Kent OPP officer has been charged with manslaughter and criminal negligence causing death following a fatal shooting in July 2021.

Ontario's Special Investigations Unit (SIU) says it has reasonable grounds to believe Const. Sean O'Rourke committed criminal offences in relation to the death of 24-year-old man.

The incident began around 4:30 a.m. on July 7, 2021 when OPP officers responded for reports of a gas theft from a local station.

Police spotted the suspect vehicle, following it westbound on Highway 401, when the car lost control and rolled into the centre ditch near Highgate, Ont.

The SIU says during an interaction with the suspect in the vehicle, an officer discharged his firearm. The driver was taken to hospital where he was later pronounced deceased.

The investigation into the death shut down Highway 401 in both directions for hours, causing long delays.

O'Rourke was arrested Friday and then released on an undertaking with conditions.

He is next scheduled to appear in a Chatham court on Feb. 16.

OPP Association President Rob Stinson released a statement late Friday saying they supported O'Rourke and other officers at the scene that night.

He added that their members have cooperated with the SIU and called the event itself "tragic," and encouraged members in need of support to reach out.

"Our lawyers will vigorously defend the actions of our officer in a court of law. The upcoming judicial process will be long and stressful for all impacted and we urge all OPPA Members who are impacted by this incident to reach out for professional and or peer mental health supports.”

A veteran Chatham-Kent OPP officer was charged Friday with manslaughter and criminal negligence causing death in the fatal shooting of a 24-year-old man on Highway 401 in July.

Joseph Martino, director of the Special Investigations Unit, said there were reasonable grounds to charge Const. Sean O’Rourke with manslaughter and criminal negligence causing death in the July 7, 2021, shooting.

O’Rourke joined the OPP in January 1998 and has served in Chatham-Kent since March 2004, said Bill Dickson, OPP media relations manager.

“As his matter is before the courts, we can’t comment on any specifics about the incident, but I can tell you we treat this the same way as we treat any other individual charge or criminal offence,” he said Friday afternoon.

“They are afforded due process through the court process and then any other disciplinary processes that fall under the terms of the Police Services Act.”

Dickson said O’Rourke is suspended with pay.

He was arrested Friday by members of the SIU and later released. O’Rourke is scheduled to appear Feb. 16 in a Chatham court.

The SIU provided a brief account of what its investigation into the shooting revealed. The agency said Chatham-Kent OPP officers responded July 7, 2021, to a report of a gasoline theft.

Officers located the car they believed the suspect was driving travelling west on Highway 401 and followed it, the SIU said. The car ended up in the ditch dividing the highway.

“One of the officers approached the vehicle, and his firearm discharged and shot the driver,” the SIU said.

The man died later in hospital. His name has not been released.

The SIU said it would not make any more comment on the investigation because the matter is before the courts.

OPP officer charged in fatal July 2021 shooting in Chatham-Kent following SIU investigation

The Special Investigations Unit (SIU) has charged an Ontario Provincial Police (OPP) officer in connection with the shooting death of a 24-year-old man in southwestern Ontario in the summer of 2021.

The police watchdog said officers with Chatham-Kent OPP were initially called around 4:30 a.m. on July 7, 2021 for a theft at a local gasoline station.

Officers later spotted the vehicle involved in the theft travelling west on Highway 401 and pursued it, the SIU said.

At some point, the vehicle crashed into a ditch dividing the highway and one officer approached it.

The SIU said an interaction occurred, resulting in the officer shooting the driver.

He was taken to the hospital, where he was pronounced dead.

In the news release issued Friday, the SIU said that following the investigation into the incident, Director Joseph Martino found reasonable grounds to believe that the officer committed criminal offences.

The SIU announced Friday that Ontario Provincial Police (OPP) Const. Sean O’Rourke is facing one count of manslaughter and one count of criminal negligence causing death in the fatal shooting in Chatham-Kent.

The constable was arrested Friday and was released on an undertaking with conditions, the SIU said.

“As the matter is before the courts, and in consideration of the fair trial interests of the accused, the SIU will not provide further comment on the investigation."

O’Rourke is scheduled to appear in a Chatham court next month.

The SIU is called in to investigate whenever police are involved in a death, serious injury, sexual assault allegations or the discharge of a firearm at a person.

The union representing OPP officers released a statement in support of O'Rourke, saying he and his fellow officers who responded to the incident "acted in the good faith performance of their duties."

"Our members have cooperated as mandated by law with the investigation led by the Special Investigations Unit. It was an absolutely tragic event. Our lawyers will vigorously defend the actions of our officer in a court of law," OPP Association President Rob Stinson said in the statement.

A former Collingwood Police Service officer, now serving with the OPP in Chatham, has been charged by the province’s Special Investigation Unit (SIU) with manslaughter.

Const. Sean O’Rourke is also charged with one count of criminal negligence causing death, following the SIU’s investigation into the shooting death of a 24-year-old man in Chatham-Kent last July.

The investigation found that on July 7, 2021, the Chatham-Kent OPP responded to a call about a gasoline theft. Officers located the vehicle believed to be involved travelling westbound on Hwy. 401 and followed it.

O’Rourke served with the Collingwood force in the 1990s, and was with the force when the town contracted with the OPP for policing services in 1998.

In a statement, the president of the OPP Association — the union representing the OPP's front-line officers — expressed his support for the constable, "and all of our members who acted in the good faith performance of their duties" during the incident.

"Our members have cooperated as mandated by law with the investigation led by the Special Investigations Unit. It was an absolutely tragic event," read the statement from Rob Stinson. "Our lawyers will vigorously defend the actions of our officer in a court of law. The upcoming judicial process will be long and stressful for all impacted and we urge all OPPA Members who are impacted by this incident to reach out for professional and or peer mental health supports."

O’Rourke was arrested by members of the SIU on Jan. 14, and subsequently released on an undertaking with conditions. He is required to appear in court in Chatham on Feb. 16.

A Chatham-Kent OPP officer has been charged following a fatal shooting on the 401 last summer.

Police initially responded to a call about a gas theft on July 7, located the suspect vehicle heading west on the 401 and gave chase. The vehicle ended up in the centre median near Ridgetown.

According to investigators, one officer approached the vehicle and shot the driver, who later died in hospital.

Constable Sean O’Rourke has been charged with manslaughter and criminal negligence causing death. He was arrested on Friday, released with conditions, and will appear in court on February 16th.

The SIU has declined any further comment on the case as the matter is before the courts.

The Ontario Provincial Police Association issued a statement in support of Constable O’Rourke.

An initial disclosure was provided to O’Rourke’s defence lawyer, and the case was adjourned until March 30, when it’s anticipated that additional disclosure will be requested. O’Rourke is a 24-year veteran OPP who joined Chatham-Kent OPP in 2004. He’s been suspended with pay since Ontario’s police watchdog, the Special Investigations Unit (SIU), charged him on Jan. 14.

On the day of the deadly shooting, Chatham-Kent OPP officers responded to a reported gasoline theft and located the car they believed the suspect was driving, westbound on the 401, the SIU said.

The car ended up in the ditch dividing the highway near the Highgate exit, where an officer approached the vehicle and fired their gun, the SIU said.

A Chatham-Kent OPP officer charged with manslaughter after a fatal shooting on Highway 401 last summer will return to court in about two weeks to provide time to arrange a pre-trial hearing.

Sean O’Rourke, a 24-year veteran officer, also faces a charge of criminal negligence causing death following the July 7, 2021, shooting during an officer response to a reported gas theft.

During O’Rouke’s brief appearance Wednesday, the court heard there is still some evidence to be received. His lawyer will be arranging a judicial pre-trial – a hearing held to resolve any simple issues – so requested a two-week adjournment.

The officer’s case returns to court on May 11.

There are two publication bans in place, including one that prohibits publication of any information that could identify the victim or witnesses, and another prohibiting the publication of any evidence heard during the pre-trial stage.
