When police officers are involved in incidents where someone has been seriously injured, dies or alleges sexual assault, the Special Investigations Unit has the statutory mandate to conduct independent investigations to determine whether a criminal offence took place.

Shellome Peart was killed last November when her Honda was broadsided by a fleeing suspect

Ontario’s Special Investigations Unit has cleared an Ontario Provincial Police officer of wrongdoing in the death of Shellome Peart, 21, after a violent, high-speed collision in Brampton last Nov. 5.

“There is no basis to proceed with criminal charges against the officer,” said Joseph Martino, SIU director, in his report.

In the early hours of Nov. 5, 2021, the OPP officer started pursuing the driver of a Jetta who had run a red light.

The officer sped after the car for a brief time — just slightly over one minute — before disengaging the pursuit as they were going eastbound on Sandalwood Pkwy. E.

The SIU investigation found the officer had reached a speed as high as 131 km per hour for a short distance before deciding to discontinue the pursuit.

The 25-year old driver of the Jetta continued at high speed.

When he entered the next intersection on Dixie Rd. — on a red light — he broadsided a Honda Civic at 2:44 a.m.

Peart, who was driving the vehicle that was struck and caught on fire, died later that morning in hospital after suffering what the SIU described in its report as “catastrophic” injuries.

The impact and violence of the collision propelled Peart’s Honda metres away onto the side of the roadway.

The Jetta that crashed into her came to a stop along Dixie Rd.

The injured driver fled northbound on foot, leaving behind a passenger in the Jetta — a 25-year-old man — who was seriously injured with multiple fractures.

“It is highly regrettable that the driver of the Jetta chose to operate their vehicle as recklessly as they did, resulting in the tragic loss of (Peart’s) life,” the SIU report said.

“Be that as it may, I am unable to reasonably conclude on the aforementioned-record that the SO (subject official) transgressed the limits of care prescribed by the criminal law with respect to his involvement in the events culminating in the collision.”

The OPP officer declined — as is their right — to be interviewed for the SIU investigation.
