NORTHUMBERLAND COUNTY — A Northumberland OPP officer who was honoured by the Governor General of Canada is facing charge a charge of sexual assault and sexual interference in relation to an investigation by the Provinces Special Investigation Unit.

Northumberland OPP Const. James Orser is facing two counts of sexual assault and one count of sexual interference.

Orser and another officer were awarded the Medal of Bravery from the Governor General of Canada Michaelle Jean in February, 2010 pertaining to a fatal fire on October 27, 2006 in Campbellford.

Twice, another officer entered into the blazing apartment in an attempt to reach the victims, but both times, he was forced out due to the extreme heat and smoke. The officer again re-entered, this time with Orser, but the officers were unsuccessful in reaching any of the children. Firefighters arrived and pulled the victims from the blaze. Two of the young victims died.

Director of the Special Investigations Unit, Ian Scott, said there are “reasonable grounds to believe” that Orser committed crimes in relation to a July 2010 incident involving two females –– one who was 14 at the time of the incident, and one who was 18.

The SIU was contacted by the OPP regarding a complaint against the officer and an investigation was launched.

The officer will appear in Cobourg court on July 25, 2012.

As this matter is now before the courts, the SIU will make no further comment pertaining to this investigation.

Northumberland OPP Inspector Doug Borton said he could not specifically comment on the investigation, but said, "public trust and confidence is the cornerstone of the OPP and as an organization, the OPP hold their members accountable for their actions both on or off duty. "Although I cannot speak specifically to the matter that resulted in the arrest of James Orser by the province's Special Investigations Unit, I can confirm that he has been suspended from duty."

The SIU is an arm’s length agency that investigates reports involving police where there has been death, serious injury or allegations of sexual assault.

NORTHUMBERLAND -- A Northumberland OPP officer charged with sexual assault needs more time to retain a lawyer.
On Aug. 8 at Cobourg's provincial court on William Street, OPP Constable James Orser stood charged with two counts of sexual assault and one count of sexual interference.

Const. Orser told Justice Robert Graydon he had yet to retain counsel, but was seeking a lawyer through the OPP Association.

"I've had no disclosure to provide counsel," Const. Orser told Justice Graydon, when asked why it's taken this long to retain a lawyer.

Before proceedings began, crown attorney Ian Bulmer, provided Const. Orser with his disclosure.

Justice Graydon was going to allow until Sept. 5 for Const. Orser to seek counsel, who had his first appearance in court on July 25.

However, Justice Graydon changed his mind and set Aug. 29 as the next date where, "either you or a lawyer must be here on your behalf.

"I want to make sure a lawyer is on record as soon as possible," said Justice Graydon.

The Province's Special Investigations Unit (SIU) announced the sexual assault charges against Const. Orser June 14. He is accused of inappropriate conduct involving two teenaged girls, ages 14 and 18, during an incident in July 2010.

The SIU is an arm's-length agency that investigates reports of death, serious injury or sexual assault involving police officers.

NORTHUMBERLAND -- A Northumberland OPP officer charged with sexual assault needs more time to retain a lawyer, court heard Wednesday.
On Aug. 29 at Cobourg's provincial court on William Street, OPP Constable James Orser stood charged with two counts of sexual assault and one count of sexual interference. The appearance was his third without counsel.

On Aug. 8, Const. Orser told Justice Robert Graydon he had yet to retain a lawyer, but was seeking counsel through the OPP Association. Justice Graydon told Const. Orser he had until Aug. 29 to hire someone.

During his recent court date, Const. Orser explained to Madame Justice Lisa Cameron he had spoken to an association lawyer, but had not officially retained counsel.

Const. Orser said the lawyer he was looking to retain was away on holidays and due back to work the first week of September. Only then would he be officially hired on to represent him, Const. Orser said.

Justice Cameron set a new court date for Sept. 26.

"Bring (a lawyer) with you that day or a letter from him confirming you have retained him," Justice Cameron told Const. Orser.

NORTHUMBERLAND -- A case involving a Northumberland County OPP officer charged with sexual assault won't be heard until December, court heard Wednesday.
On Nov. 7 at Cobourg's provincial court on William Street, OPP Constable James Orser stood charged with two counts of sexual assault and one count of sexual interference.

Const. Orser stood before Justice Robert Graydon who asked him if he had retained counsel yet. In three previous appearances, Const. Orser had not.

During his recent court date, which marked Const. Orser's fifth appearance, he provided the court with a letter stating he had retained counsel through the OPP's association. Const. Orser's lawyer was busy with another matter during the OPP officer's recent appearance and was unable to attend court.

Justice Graydon set a new court date for Dec. 5.

The Province's Special Investigations Unit (SIU) announced the sexual assault charges against Const. Orser June 14. He is accused of inappropriate conduct involving two teenaged girls, ages 14 and 18, during an incident in July 2010.

NORTHUMBERLAND -- A sexual assault case against a Northumberland County OPP officer is heading towards a judicial pre-trial, court heard Wednesday.
The case involving OPP Constable James Orser, charged with two counts of sexual assault and one count of sexual interference, will come back to court Dec. 19 at 9:30 a.m., at which point Justice Robert Graydon will set a date for the judicial pre-trial.

Judicial pre-trial, which usually happens behind closed doors in the judge's chambers, is when the accused, his lawyer and the crown attorney mull over legal issues and information which will be brought up during the course of a trial. During this meeting, all the parties involved could reach a resolution agreement or realize that no resolution is possible before trial.

Woman tells court about sexual assault at home of Northumberland cop

OSHAWA -- A witness has testified she and a teenaged friend were sexually assaulted after a night of drinking at a Northumberland OPP officer’s home.

“He came onto me very strongly,” the woman, now 22, testified Tuesday. “He was pulling at my clothes.”

Constable James Orser has pleaded not guilty to charges relating to an incident the Crown alleges occurred in July of 2010 in Campbellford. Two young women, who were aged 14 and 18 in 2010, have testified they were sexually assaulted by the officer.

The trial is being heard by Superior Court Justice Ted Minden in Oshawa. A publication ban prohibits reporting information that might identify either complainant.

The woman who testified Tuesday said that she and her friend were hanging out in Campbellford on a summer night when she got a call from Const. Orser, with whom she had exchanged phone numbers after he conducted a domestic assault investigation. She said the two girls went to the cop’s house, where he served them drinks and invited them into his hot tub.

At one point the younger girl was in the officer’s lap as they sat in the tub, the woman testified. She said that they later resumed drinking inside the house, and wound up in a bedroom.

The witness said she was sitting on the bed talking to the younger girl when she was assaulted by Const. Orser.

“He’s coming onto me strong, grabbing my clothes, trying to take off my pants. He did take off my pants,” she said. “I was very intoxicated. He forced himself on top of me.”

The woman said that she managed to break away and leave the room, where she put her pants back on. “When I came back in he was on top of (the other girl) having sex with her,” she said.

She said she shouted at Const. Orser to stop and demanded he drive the girls to a friend’s residence outside of town. The two girls parted the next day and didn’t have contact thereafter, court heard.

Both young women have testified they were reluctant to disclose the incident. The witness said Tuesday she at first refused to talk to investigators, but eventually told her story.

Const. Orser was charged in 2012 with sexual assault and sexual interference following an investigation by the Special Investigations Unit, an independent agency that investigates allegations of injury or sexual assault involving police.

The trial continues.

Northumberland OPP officer James Orser found not guilty of sexual assault

OSHAWA -- A judge has acquitted a Northumberland OPP officer of sex crimes against two teenaged girls who claimed they were assaulted at his Campbellford home in the summer of 2010.

The stories told by the young women were riddled with inconsistencies too numerous to ignore, Superior Court Justice Ted Minden said in pronouncing Constable James Orser not guilty Friday, April 10.

“There were many discrepancies on matters large and small,” the judge said. “Their versions were consistently inconsistent. They did not come close to meshing with each other.”

Const. Orser, who was charged with two counts of sexual assault and one count of sexual interference after an investigation by the Province’s Special Investigations Unit, thanked the judge and shook hands with defence lawyer Harry Black. But outside court he declined comment.

“Not today,” he said. “I need time.”

During a trial that began March 30 in Oshawa, Justice Minden heard testimony from witnesses including the two women and Const. Orser. The women, aged 14 and 18 at the time they claimed to have been assaulted, said they went to Const. Orser’s home on a night in July 2010. They testified they were given alcohol and invited into a hot tub, eventually winding up in a bedroom where they were both sexually assaulted.

Const. Orser denied either girl was at his house. He claimed he hadn’t met the 14 year old prior to the night in question, but was familiar with the 18 year old because he’d helped her deal with an abusive boyfriend.

The women offered differing and shifting accounts of the incident, including key elements such as when they arrived at Const. Orser’s house and the way in which the alleged assaults occurred.

The older woman, now 22, also acknowledged that for two years she told investigators from the OPP and SIU she’d had no sexual contact with Const. Orser. Her story changed in 2012 when she was in custody and facing penitentiary time for a serious assault, court heard. She denied tailoring her story to broker a deal with authorities.

“I have nothing but her word on that,” Justice Minden said in analyzing Mr. Black’s suggestion that the woman had changed her story to benefit herself. “This is a possibility that can’t be ignored,” he added.

Prosecutor Peter Scrutton had urged the judge to accept the testimony of the two women, reasoning that the inconsistencies in their accounts actually proved they hadn’t colluded to frame the cop. He said the Crown’s case was bolstered by a snippet of video, caught when one of the girls inadvertently triggered the video function on her cellphone, that shows blurred and shaky images from inside Const. Orser’s house.

In assessing the video Justice Minden noted that Const. Orser had testified he generally left his house unlocked. And while the video clip captures two girls’ voices, there’s no evidence Const. Orser was there when it was taken, he said.

“There is no evidence as to when it was created,” Justice Minden said of the video.

OSHAWA, Ont. - An OPP officer has been acquitted of sex-related charges arising from complaints by two women.

A trial for Const. James Orser ended Wednesday in Oshawa and Justice Ted Minden delivered his verdict on Friday.

Orser was charged with two counts of sexual assault and one count of sexual interference by the province's police watchdog, the Special Investigations Unit, in June, 2012.

Two women made allegations of sexual assaults at Orser's home in Campbellford, Ont., in July of 2010, when one of them was 14 and the other was 18.

The OPP professional standards bureau has been conducting a Police Service Act investigation, and an update on the status of that is expected on May 13.
